Draft — not yet binding

Pending legal review. Published because it describes the deal we actually intend, but it is not yet an enforceable contract and the operating entity is not yet named.

1. The service

We monitor Swiss public procurement awards published on SIMAP, classify them by supplier sub-niche, and send you the ones matching your profile. We are not affiliated with SIMAP, the Confederation, or any cantonal procurement office.

2. Exclusivity

A subscription grants exclusive delivery for one sub-niche: while it is active, we will not sell the same sub-niche to another customer. The boundary of the sub-niche is agreed in writing before the subscription starts.

Exclusivity covers our delivery, not the underlying facts. SIMAP awards are public, and anyone — including your competitors — may read them at the source. If your subscription ends, the sub-niche returns to the pool immediately.

3. Fees

CHF 890 per month per sub-niche, billed monthly in advance. Prices exclude VAT unless stated otherwise. Cancel at any time, effective at the end of the paid month; we do not refund part-months.

4. What we do not promise

We pass on what SIMAP publishes. We do not warrant that SIMAP is complete, timely or correct, and awards are sometimes corrected after publication. We do not promise a minimum number of awards in any period — some weeks a niche has none, and we would rather send nothing than pad the briefing.

Sub-niche classification is produced by an automated system and will occasionally be wrong. Tell us and we will correct it. Nothing we send is legal, procurement or investment advice, and commercial decisions you take on the basis of a briefing are yours.

5. Acceptable use

The subscription is for one company. Do not resell, syndicate or forward briefings to third parties — that is the one thing that destroys the exclusivity everyone else is paying for. Do not attempt to scrape or resell the service output in bulk.

6. Liability

To the extent permitted by law, our liability is limited to the fees you paid in the twelve months before the claim. Exact wording pending legal review.

7. Governing law

The contracting entity is [PLACEHOLDER-LEGAL-ENTITY], [PLACEHOLDER-ADDRESS]. Governing law and place of jurisdiction: [PLACEHOLDER-JURISDICTION].
